myTC FOR BUSINESS TERMS OF USE

By using myTC Insights, myTC Online and any other tools, functionality and/or platforms made available by Travel Counsellors Ltd from time to time (together, the “Software”) you agree to comply with the terms set out below. Please read these terms carefully. If you do not agree to these terms, you must not access or use any of the Software or any training materials related to the Software (together, the “Documents”).

myTC Insights, myTC Online and any other tools, functionality and/or platforms are operated by Travel Counsellors Limited under company number 2133414 whose registered office at Venus Building, No.1 Old Park Lane, Trafford City, Manchester, M41 7HA. All references to ‘we’, ‘us’ ‘our’ includes Travel Counsellors Limited and all our Group Companies and our Group Companies may enforce these terms.

For the purposes of these terms ‘Group’ means in relation to a company, that company, any subsidiary or any holding company from time to time of that company, and any subsidiary from time to time of a holding company of that company. Each company in a Group is a ‘Group Company’.”

1. We do not sell any Software or Documents to you. We (or our third party licensors) remain the owners of the Software and Documents at all times. You have no rights in, or to, the Software or the Documents other than the limited right to use them in accordance with these terms.

2. You must not:

(a) copy the Software or Documents except where such copying is incidental to normal use of the Software, or where it is necessary for the purpose of back-up or operational security;

(b) rent, lease, sub-license, loan, translate, merge, adapt, vary or modify the Software or Documents;

(c) make alterations to, or modifications of, the whole or any part of the Software;

(d) disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the Software nor attempt to do any such thing except to the extent that (by virtue of section 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are essential for the purpose of achieving inter-operability of the Software with another software program;

(e) access the Software in source code form;

(f) use the Software to publish (or facilitate the publication of) any material that is defamatory or likely to give rise to an allegation of defamation, offensive, obscene, sexually explicit, discriminatory or deceptive or otherwise reasonably likely to cause offence, embarrassment or annoyance to others;

(g) remove any copyright notice from any Software or Documents; and

(h) sell, licence, provide or otherwise make available the Software or Documents in whole or in part, in any form to any person.

3. You must treat any password, or any other piece of information used as part of security procedures to access the Software or Documents, as confidential. You must not disclose it to any third party. We have the right to disable any user or password, where we have grounds to suspect that log-in credentials have been compromised or shared.

4. We may collect and use usage data in connection with your use of the Software and Documents, including meta data relating thereto. Please see our privacy policy here for information on what personal data we may collect, for what purposes we may use it, your rights in relation to your personal data and how you may exercise such rights.

5. We do not guarantee that the Software, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Software at any time for business or operational reasons.

6. Where links are provided to other sites and resources provided by third parties, these links are provided for information only. We have no control over the contents of those sites or resources and we do not give any approval in respect of such linked websites or information you may obtain from them.

7. We amend these terms from time to time. Every time you wish to use the Software or Documents, please check these terms to ensure you understand the terms that apply at that time.

8. These terms and conditions, their subject matter and formation (and any non-contractual disputes or claims) are governed by English law. You irrevocably agree to the exclusive jurisdiction of the courts of England and Wales.
